  Warren S. Radler
 
Warren S. Radler is a Principal of Trial Run Inc., a litigation consulting and trial training firm with offices in Chicago, Pittsburgh and Washington, D.C.

Mr. Radler is the former chairman and senior trial partner of a large multi-state litigation firm. He is a Fellow of the American College of Trial Lawyers.

During his years in private practice, he tried numerous complex cases to jury verdict throughout the country on behalf of plaintiffs and defendants. He has defended multi-national chemical and drug companies in product liability cases involving millions of dollars and served as national coordinating counsel in complex product liability and construction litigation cases. He has tried many cases to verdict on behalf of plaintiffs including serious personal injury, anti-trust and environmental matters. On behalf of corporations and individuals, Mr. Radler has also tried major securities, fraud and employment discrimination cases.

His appellate experience includes oral arguments before the United States Courts of Appeal for the Second, Fifth, Seventh, Ninth and Tenth Circuits and before the Court of Appeals of the State of New York. He has also argued cases before appellate courts in the states of New York, Illinois, Ohio and Massachusetts.

He is admitted to practice before all Illinois and New York courts, The Supreme Court of the United States and various Federal District Courts and Circuit Courts of Appeal. He has been admitted pro hac vice for trials in many state courts.

Mr. Radler has taught both basic and advanced trial advocacy throughout the country as a faculty member of the National Institute for Trial Advocacy as well as in the United Kingdom. He has lectured on trial advocacy at a number of law schools. Mr. Radler has just co-authored with David Malone and published through Trial Run Inc. an extensive handbook for trial lawyers — Federal Rules of Evidence with Comments. He is a graduate of Cornell University and The Cornell Law School.

Trial to verdict or settlement during trial of hundreds of cases, including commercial and corporate business disputes, antitrust, products liability, personal injury, environmental and white collar crimes. Represented both plaintiffs and defendants.

Examples of cases tried:

  • Trial to jury on behalf of plaintiff corporation under Robinson Patman Act, Section 2. Verdict in favor of plaintiff for $27,000,000 (Federal Court - Indianapolis; 3 months).
  • Trial to successful verdict of action on behalf of multi-national corporation for declaratory relief relative to potential Superfund cleanup costs and third party claims. Court granted declaratory relief and ordered future indemnity in amount of approximately $60,000,000 (Federal Court - Nashville; 3 months).
  • Trial to jury in defense of multi-national chemical company (State Court - Indiana; 4 months; State Court - Ohio; 7 months).
  • Defense of major securities company in class action age discrimination suit. Case settled favorably for defendant after four weeks of trial (Federal Court - Chicago).
  • Trial on behalf of plaintiff injured in small plane crash. Verdict in favor of plaintiff for $3,500,000 (State Court - California; 4 months).
  • Defense of CEO of manufacturing company charged with murder for death of employee in work place (State Court - Illinois).

Appellate experience includes oral arguments on numerous occasions before United States Court of Appeals for the Second Circuit, Seventh Circuit, Fifth Circuit, Ninth Circuit, and Tenth Circuit and before the Court of Appeals of the state of New York and intermediate appellate courts in New York, Ohio, Illinois and Massachusetts.
