David Malone is a Principal of Trial Run Inc., a litigation consulting and trial training firm with offices in Chicago, Pittsburgh and Washington, D.C.

Mr. Malone was a federal prosecutor for 15 years handling lengthy and complex antitrust and consumer cases involving extensive preparation in both direct and cross-examination of expert witnesses. He is a nationally recognized expert on the preparation and examination of expert witnesses.

After his government service, Mr. Malone entered private practice in Washington, D.C. and became the head of the litigation department of a Washington law firm where he handled both the plaintiff and defense side of antitrust matters, product liability suits, RICO claims, professional and corporate officer malpractice and suits for corporate control.

Mr. Malone has taught hundreds of advanced and basic trial advocacy, expert witness, deposition and other trial-related programs across the United States, in England and Russia. He has taught for the National Institute for Trial Advocacy, the American Bar Association, the State Department, private corporations, law firms, and for federal and state agencies. He has been a Professorial Lecturer in the Law at George Washington University School of Law and an Adjunct Professor of Trial Advocacy at the University of Virginia Law School.

Mr. Malone is the author of many texts and handbooks for practitioners including The Effective Deposition, a widely used text on deposition practice and procedure, Expert Rules, Deposition Rules, Winning Depositions and Winning with Experts, and a new book entitled, Effective Expert Testimony. Among numerous articles on trial practice, he has written "The Zodiac Expert: Reliability After Kumho Tire," "Why Most Deposition Preparation Fails," and "Persuasive Expert Testimony." "The Daubert Deposition Dance" examines changes in deposition practice necessitated by Daubert reliability inquiries. A recent law review article analyzes whether accounting and economic experts on damages can survive Daubert reliability challenges.

Mr. Malone is a graduate of the University of Notre Dame and earned his J.D. from the University of Virginia. He is a member of the Virginia, D.C. and Maryland federal and state bars, the Bar of The Supreme Court of the United States, and various federal district court and circuit court bars across the country.
